These Terms of Service govern your use of calmi-paws.com (the "Site") and your purchase of our products. By accessing the Site or placing an order, you agree to be bound by these terms. Please read them carefully.
CalmiPaws is operated by SJM International Limited. Our full company details are set out at the end of these terms.
1. Who may use the Site
You must be at least 18 years old and able to enter into a legally binding contract to place an order with us. By placing an order you confirm that you meet these requirements and that the information you provide is accurate and complete.
2. Our products
CalmiPaws sells pheromone-based calming diffusers and related accessories for pets. We make every effort to display the colours, images and specifications of our products as accurately as possible, but we cannot guarantee that your screen will reproduce them exactly. Minor variations in packaging and appearance may occur.
Certain products may be available exclusively online, in limited quantities.
3. Product use and veterinary advice
CalmiPaws products are general wellbeing products for pets. They are not veterinary medicines, and nothing on our Site or in our marketing is intended as veterinary advice, diagnosis or treatment.
Results vary between animals. Our products are not a substitute for professional veterinary care. If your pet shows signs of illness, injury, distress or a persistent behavioural problem, consult a qualified veterinarian.
Always follow the instructions supplied with the product. Keep the product out of reach of children and pets, and do not use it in a manner other than as directed.
4. Orders and contract formation
Placing an order is an offer to purchase. Your order is accepted, and a contract is formed, when we send you an email confirming that your order has been dispatched — not when you receive an order acknowledgement or a payment confirmation.
We may refuse or cancel any order, including where the product is unavailable, where there has been a pricing or description error, where we are unable to verify your payment or delivery details, or where we suspect fraudulent activity. If we cancel an order after you have paid, we will refund you in full.
5. Prices, taxes and duties
All prices are shown on the Site in the currency indicated at checkout and are subject to change without notice. The price that applies is the price displayed at the time your order is accepted.
Where a product is listed at an incorrect price due to an obvious error, we are not obliged to supply it at that price and will contact you to confirm whether you wish to proceed at the correct price or cancel.
For international deliveries, import duties, taxes and customs charges may be payable on arrival. These are not included in our prices and are your responsibility. Customs policies vary by country — please check with your local customs office if you are unsure.
6. Payment
Payment is taken at checkout through our payment providers. We do not store your full card details. You confirm that you are authorised to use the payment method you provide.
7. Shipping and delivery
Estimated delivery times are shown at checkout and are estimates only. We are not responsible for delays caused by carriers, customs clearance or events outside our reasonable control.
Risk of loss or damage passes to you on delivery. If your order arrives damaged or does not arrive within a reasonable time, contact us at support@calmi-paws.com and we will put it right.
8. Cancellations, returns and refunds
Our Refund Policy forms part of these terms and sets out how to return a product and how refunds are processed.
If you are a consumer in the United Kingdom or the European Economic Area, you also have a statutory right to cancel your order within 14 days of receiving the goods, without giving a reason, and to receive a refund in accordance with applicable law.
9. Your consumer rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that applies to you under law and cannot lawfully be excluded. In particular:
- Australia: our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure.
- New Zealand: your rights under the Consumer Guarantees Act 1993 apply where you acquire goods as a consumer.
- United Kingdom: your rights under the Consumer Rights Act 2015 apply, including that goods must be of satisfactory quality, fit for purpose and as described.
- European Economic Area: your rights under applicable consumer protection law, including the legal guarantee of conformity, apply.
- United States and Canada: your rights under applicable federal, state and provincial consumer protection law apply.
Where any part of these terms conflicts with those rights, those rights prevail.
10. Accuracy of information on the Site
We aim to keep the information on our Site accurate and current, but we do not warrant that product descriptions, prices, availability or other content are free of errors. We may correct errors, inaccuracies or omissions, and update information, at any time without prior notice.
11. Changes to the Site and products
We may modify, suspend or discontinue any part of the Site or any product at any time without notice. We are not liable to you for doing so, except where you have already paid for a product we can no longer supply, in which case we will refund you.
12. Acceptable use
You may not use the Site or its content:
- for any unlawful purpose, or to encourage others to act unlawfully
- to breach any law, regulation or rule that applies to you
- to infringe our intellectual property rights or those of anyone else
- to submit false, misleading or fraudulent information
- to upload malicious code, or to interfere with the security or operation of the Site
- to scrape, harvest or systematically extract content from the Site
We may suspend or terminate your access to the Site if you breach this section.
13. Intellectual property
All content on the Site — including text, product photography, graphics, logos, and the CalmiPaws name and branding — is owned by or licensed to us and is protected by intellectual property law. You may not reproduce, duplicate, copy, sell, resell or exploit any part of it without our prior written permission.
14. Reviews, comments and submissions
If you submit a review, comment, photograph, suggestion or other content to us or to the Site, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit and publish it in connection with our business.
You confirm that any content you submit is your own, is truthful, reflects your genuine experience, and does not infringe anyone else's rights. We may remove content that is inaccurate, misleading, offensive or unlawful. We do not offer payment, discounts or other incentives in exchange for positive reviews.
15. Third-party tools and links
The Site may link to or make available third-party websites, tools and services that we do not control or monitor. We provide them for convenience only and are not responsible for their content, accuracy, availability or privacy practices. Your use of them is at your own risk and subject to their own terms.
16. Privacy
Our handling of your personal information is governed by our Privacy Policy, which forms part of these terms.
17. Disclaimer of warranties
Except as set out in section 9 and to the extent permitted by law, the Site and our products are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that any particular result will be achieved through use of our products.
18. Limitation of liability
Subject to section 9 and to the extent permitted by law:
- our total liability to you in connection with any order is limited to the amount you paid for the products giving rise to the claim
- we are not liable for indirect or consequential loss, loss of profit, loss of data, or loss of opportunity
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
19. Indemnity
You agree to indemnify us and our officers, employees and service providers against any claim, demand, loss or expense (including reasonable legal fees) arising from your breach of these terms, your misuse of the Site, or your violation of any law or third-party right.
20. Events outside our control
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including natural disasters, epidemics, strikes, carrier failures, customs delays, power or network failures, or acts of government.
21. Governing law and disputes
These terms are governed by the laws of Hong Kong, and the courts of Hong Kong have non-exclusive jurisdiction over any dispute.
If you are a consumer, this does not deprive you of the protection of the mandatory consumer laws of the country in which you are resident, and you may also bring proceedings in the courts of that country.
Before starting formal proceedings, we ask that you contact us at support@calmi-paws.com so we can try to resolve the matter directly.
22. General
If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision is not a waiver of it. These terms, together with our Privacy Policy and Refund Policy, form the entire agreement between us in relation to your use of the Site and your purchases.
23. Changes to these terms
We may update, change or replace any part of these terms by posting an updated version on this page with a new revision date. The version in force at the time you place an order is the version that applies to that order.
